KUALA LUMPUR (Jan 27): Serba Dinamik Holdings Bhd managing director and chief executive officer Datuk Mohd Abdul Karim Abdullah’s trial in relation to furnishing a false statement to Bursa Malaysia has been fixed for further case management on Feb 28 at the Sessions Court.

It was learned that during case management held on Thursday (Jan 27), the Sessions Court set the next case management date for the prosecution to hand over documents to the accused's defence team.

The Securities Commission Malaysia (SC) was represented by deputy public prosecutor Muhammad Izzat Fauzan, while Abdul Karim was represented by Wan Aizuddin Wan Mohammed from Messrs Shafee & Co. 

Section 51A of the Criminal Procedure Code stipulates that documents that are to be used in the trial must be given to the accused before the commencement of trial. 

A month prior, the SC charged Abdul Karim in relation to Serba Dinamik’s submission of a false statement to Bursa Malaysia.

Abdul Karim, in his capacity as a director of the oil and gas company, was charged under Section 369(a)(B) of the Capital Markets and Services Act 2007 (CMSA), in relation to a false statement contained in the company’s quarterly report for the quarter ended Dec 31, 2020.

As Abdul Karim is a director of the group, he is deemed to have committed the offence under Section 367(1) of the CMSA, and punishable under Section 369 of the same act.

The accused pleaded not guilty and claimed trial. If found guilty, Abdul Karim is liable to a jail term not exceeding 10 years and a fine not exceeding RM3 million.

The SC in a prior statement dated Dec 28, 2021, said the false statement submitted to Bursa was in relation to a revenue figure of RM6.014 billion contained in the quarterly report.
