KUALA LUMPUR (Nov 1): Former top cop Datuk Ramli Yusoff filed today a suit against former Inspector-General of Police (IGP) Tan Sri Musa Hassan, Attorney-General (A-G) Tan Sri Abdul Gani Patail and 10 others for what he described as abuse of power, false and malicious prosecution against him six years ago.

Ramli, a former Commercial Crime Investigation Department director, is also suing them for abuse of prosecutorial discretion, malicious prosecution and prosecutorial misconduct or public misfeasance for having acted in such manner against him without any reasonable cause.

Together with his lawyers, Ramli filed the suit at the Kuala Lumpur High Court to claim for punitive, aggravated and exemplary damages.

Ramli is claiming special damages amounting to RM1.5 million, punitive damages of RM50 million, aggravated damages of RM50 million and examplary damages of RM27 million. The total of his claim amounts to almost RM130 million.

In his statement of claim, Ramli argued that the defendants had conspired against him resulting to his reputation being damaged and jeopardised his career.

“I feel it is only fair that I take action on the others, them, all the defendants for malicious prosecution and conspiracy towards me,” he said regarding the lawsuit.

He said among the claims, the examplary damages claim was a significant one because it was the same amount that he was alleged to possess during his time serving as an officer.

Ramli also said that he was not suing the defendants just for his sake alone, but also for the betterment of the police force by giving moral support.

“RM27 million is very significant because they alleged that I have an asset worth RM27 million,” he said.

“I’m doing this not for Ramli Yusuff, I’m doing this for the police force. I think the police force was demoralised at one stage because the moment they fixed a three star general, all the junior officers they are worried and they are scared.”

The lawsuit filed today is related to a few charges brought against him six years ago, which includes three charges under Section 32(2) of the Anti-Corruption Act, one charge under the Section 168 of the Penal Code and one charge under Section 16 of the Anti-Corruption Act.

However, between July 2009 and August 2010, he was acquitted of all the charges brought against him under the provisions of the Anti-Corruption Act 1997 and the Penal Code.

Other defendants named in the lawsuit includes the government, the Royal Malaysian Police, the Malaysian Anti-Corruption Commision, the A-G’s Chambers prosecution head Datuk Nordin Hassan and several other MACC officers.

Chronology of the Ramli Yusuff saga:

1998 - Tan Sri Musa Hassan and Tan Sri Abdul Gani Patail were implicated as having fabricated medical evidence in the "Black Eye" incident involving the assault and injury to former deputy prime minister Datuk Seri Anwar Ibrahim while in police custody. During this time Musa, Abdul Gani Patail and Nordin Hassan were also involved in his prosecution infamously known as Sodomy 1.

2001 - Datuk Ramli Yusuff was directed by the then IGP, Tan Sri Norian Mai to issue several show cause letters to Musa concerning breaches of discipline, procedure and protocol. This is where their relationship deteriorated.

Between 2001 and 2005 - Ramli was transferred as the Police Commissioner of Sabah and later as the Chief Police Officer of Pahang. On the other hand, Musa received several promotions and went on to become the Deputy IGP in 2005.

Sept 2006 - Musa became IGP and Ramli became CCID director. During this time Ramli was subjected to a series of actions implicating him for abuse of power, corruption and other crimes.

Abdul Gani Patail also was reported to had enmity towards him from a case handled by the ex-CCID in the investigation into the massive losses of the national airlines, Malaysian Airlines System Berhad. In the case, Ramli at the request of MAS board of directors and management had briefed the former prime minister Datuk Seri Abdullah Ahmad Badawi that there was basis to prosecute Tan Sri Tajuddin Ramli for various crime which was contrary to decision made by AGC not to prosecute him. Instead, to ear mark the case for no further action.

2007 - Abdul Gani and Musa had enlisted Nordin Hassan, Kevin Morais, and various officers of the MACC and the police Disciplinary Unit to investigate Ramli and charged him for various offences.

Nov 2007 - Ramli had three charges against him under Section 32(2) of the Anti-Corruption Act. This was sensationalised as the "RM27 Million Cop" story in news. At the same time, a summons charge under Section 168 of the Penal Code was charge against him for allegedly participating in trade while still in public office.

Nov 19, 2007 - He was charge in Kota Kinabalu under Section 16 of the Anti-Corruption Act alleging that he abused his powers for gratification by issuing directions for the use of a police aircraft.
