KUALA LUMPUR (Aug 17): Tan Sri Jamaluddin Jarjis’ mother has filed another lawsuit against the late minister’s children over the control of a purported amount of RM21 million kept in the bank.
Aminah Abdullah, 86, is suing her grandchildren Nur Anis and Ikhwan Hafiz in their capacity as joint administrators of their late father's estate.
The suit was filed at the High Court on May 31 through the firm of Wan Marican, Hamzah & Shaik.
According to the amended statement of claim dated May 31, a copy of which was sighted by The Edge today, Jamaluddin died in a helicopter crash on April 4, 2015 without leaving a will.
It states that on June 23, 2017, Nur Anis and Ikhwan Hafiz applied for letters of administration of their father's estate at the High Court.
On July 6, 2017, the court granted the letters of administration with both of them as joint administrators of the estate comprising various movable and immovable assets.
Earlier, on Oct 13, 2016, Ikhwan Hafiz had obtained a faraid (Islamic law of inheritance) certificate from the Kuala Lumpur Syariah High Court.
According to the statement of claim, Aminah discovered that her son had various local and foreign bank accounts including in the United States and United Kingdom, with total deposits of RM21.351 million as of May 2019.
After deducting Jamaluddin's liabilities totalling RM7.607 million at the time, the cash available for distribution was RM13.743 million, she claimed.
Aminah added in the statement of claim that Jamaluddin also had Tabung Haji savings totalling RM280,066, and Employees Provident Fund (EPF) savings of RM875,298 as at 2016.
She said that while she was willing to release Jamaluddin's EPF money for distribution, the two grandchildren acting as joint administrators had not requested her to do so.
Aminah also said she is entitled to one sixth of the RM13.743 million cash available for distribution (which comes to RM2.29 million) based on the faraid system
She claimed that the two grandchildren are not willing to distribute the money, and hence she is seeking a court order for them to distribute the RM2.29 million to her.
On Friday, Aminah had won another suit in the High Court with the judge ruling that she is entitled to Jamaluddin's Rantai Wawasan Sdn Bhd shares that were being held by Nur Anis and Ikhwan Hafiz.
The value of the shares is worth in excess of RM1 billion, according to her statement of claim in that suit.
Rantai Wawasan owns, among others, NUR Power, an independent power utility in Kulim, Kedah which was acquired in 2012.
Nur Anis is a director at the power plant, while Ikhwan Hafiz is both director and managing director of that facility.
The May 31 suit is the third civil suit filed by Aminah against Ikhwan Hafiz and Nur Anis. She had filed another suit on May 21 against the two grandchildren along with Messrs Wong Lu Peen & Tunku Alina, lawyer Liza Chan Sow Keng of Liza Chan & Co, and Commissioner for Oaths Tengku Fariddudin Tengku Sulaiman.
Chan is now a judicial commissioner at the KL High Court.
They are accused of being collaboratively engaged in fraud, fabrication, fraudulent concealment, misconduct and/or breaches of law to deprive Aminah's right, as a beneficiary, to a fair and proper administration of the inheritance.
Besides this, Aminah has also filed a faraid claim at the Kuala Lumpur Syariah High Court which is still pending.
