KUALA LUMPUR (Jan 12): The prosecution has not been successful in serving forfeiture documents relating to several assets linked to Jasmine Loo Ai Swan (pictured), a central character in the 1Malaysia Development Bhd (1MDB) trial.

As such, they will make an application to utilise substituted service and this will be heard before Justice Datuk Ahmad Shahrir Mohd Salleh on Jan 26, 2022.

On Nov 25, 2021, the prosecution had filed an application to forfeit properties said to be owned by Loo, a former general counsel of 1MDB.

The application had been filed at the High Court's criminal division under Section 56 of the Anti- Money Laundering, Anti-Terrorism Financing, and Proceeds of Unlawful Activity Act 2001 (AMLATFPUA).

High Court Deputy Registrar, Nur Azizah Jaafar told theedgemarkets.com on Wednesday (Jan 12) that the prosecution had failed to serve forfeiture documents on Loo and will make an application to use substituted service (utilised to serve court documents on individuals who cannot be reached or not contactable). This may be via advertisements placed in newspapers or other similar means.

In the application, the prosecution had sought to seize two vehicles and two properties, one of which is in Mukim Batu, Kuala Lumpur, theedgemarkets was given to understand. The value of the properties is unclear. The cars are said to be a Volkswagen Beetle and an Audi.

Section 56 of AMLATFPUA stipulates forfeiture of properties where there is no prosecution.

Loo, 48, had left Malaysia before the 14th general election in 2018. She is listed as a wanted person and her whereabouts are unknown.

Previously, theedgemarkets.com reported that Loo's Mont’Kiara condo was set to be auctioned off following an application filed by OCBC Bank (M) Bhd over her alleged failure to settle an outstanding loan sum of more than RM300,000.

Loo appears to be one of the central characters in Low Taek Jho's (Jho Low) inner circle in the 1MDB scandal, as her name has cropped up on numerous occasions in the present 1MDB-Tanore trial involving former prime minister Datuk Seri Najib Razak.

On Feb 9, 2021, the government through the Inland Revenue Board filed two legal suits to recover RM2.4 million in tax arrears from Loo and RM6.7 million from another Jho Low associate, Casey Tang Keng Chee.

On Feb 18, 2021, the High Court obtained a judgment in default against Loo over the unpaid tax.

Both Loo and Tang are on Bank Negara Malaysia’s wanted list.
