KUALA LUMPUR (Aug 18): The last of the Genneva Malaysia Sdn Bhd parties involved, namely Datuk Ng Poh Weng and his company Ng Advantage Sdn Bhd, have yesterday filed an appeal against the High Court's decision earlier this month where both of them are convicted and fined while Ng is facing a jail term.

Counsel Datuk Gobinath Mohanna confirmed the filing of the notice of appeal.

“Yes it has been done yesterday,” he told theedgemarkets.com.

Ng, who was Genneva Malaysia's business advisor, was sentenced to four years' jail and fined RM159 million while Ng Advantage was fined RM101 million.

In criminal cases, parties are given 14 days to file a notice of appeal against an acquittal or conviction and sentence.

Ng, 69, is also serving eight years' jail after the Court of Appeal had in 2018 upheld his and three other Genneva Sdn Bhd directors' conviction for money laundering and illegal deposit taking.

It was reported on Aug 4 that High Court Judicial Commissioner Datuk Ahmad Shahrir Mohd Salleh found Ng, along with seven other individuals and two other companies guilty of money laundering and illegal deposit taking, including Genneva Malaysia, and were sentenced to jail and fined.

Genneva Malaysia alone was fined a total of RM450 million by Ahmad Shahrir.

The Edge had previously reported that all seven individuals who have been found guilty had filed their respective notices of appeal against the conviction and sentence. 

With the filing of the notices, the Court of Appeal would be the final venue of their appeal as the case originated from the Sessions Court, as parties are given a chance of two-tier appeals.
