KUALA LUMPUR (Aug 28): Lekir Bulk Terminal Sdn Bhd (LBT), an indirect subsidiary of Tenaga Nasional Bhd (TNB), has withdrawn its application for judicial review against the Perak State government and its agencies.

In a filing with Bursa Malaysia this evening, TNB said that LBT has withdrawn its application for judical review against Majlis Pengurusan Pesisir Pantai Perak (Perak Coastal Council), Pengarah Majlis Pengurusan Pesisir Pantai Perak (Director of Perak Coastal Council), Kerajaan Negeri Perak (Perak State Government), Majlis Mesyuarat Kerajaan Perak Darul Ridzuan (Perak State Authority) and Perbadanan Kemajuan Negeri Perak (Perak State Development Corporation).

The reason for the withdrawal of the judicial review was the amendment of the 4th Schedule of the Perak Coastal Management (Licensing, Fees and Charges) Regulation 2016 on Aug 1, to state that coastal charges and fees will be zero rated (gazetted on Aug 13, 2018).

This in effect means that LBT is no longer required in law to pay coastal charges or fees to the Perak Coastal Council.

LBT is 80% owned by Pelabuhan Lumut Sdn Bhd (PLSB) and 20% owned by Tuah Utama Sdn Bhd.

Integrax Bhd, a wholly owned subsidiary of TNB, holds 100% equity interest in PLSB.

To recap, on Nov 30 last year, LBT filed an application for judicial review in the Kuala Lumpur High Court against the parties in relation to a review of the decision by the Perak Coastal Council to issue a notice of demand dated Nov 13, 2017 to LBT.

The notice of demand compelled LBT, among others, to settle an unspecified amount of coastal fee and charges within 21 days of the said notice purportedly pursuant to the Perak Coastal Council’s rights under the Perak Coastal Management Enactment 2016 and Perak Coastal Management (Licensing, Fees and Charges) Regulations 2016.

“In the event the coastal fee charges are not paid and the decision is not adhered to, LBT is faced with a threat of having its licence to operate its jetty being revoked which may result in the company having to cease its operations in the said terminal,” TNB said in its Nov 30, 2017 announcement.

TNB shares closed unchanged at RM15.72 today, for a market capitalisation of RM89.26 billion.
