(April 10): The High Court today dismissed the public prosecutor's appeal against the acquittal of PAS deputy president Mohamad Sabu and Batu MP Tian Chua who participated in the 2007 Bersih rally.

Judge Amelia Tee Hong Geok Abdullah, however, found 11 others guilty and fined them RM8,000 each in allowing the government's appeal.

“High court reversed the acquittal by Session Court & convict 11 participants in 2007 #Bersih rally, with the exception of Mat Sabu & I,” Chua who is Batu MP said in a Twitter post after the court delivered its decision.

In late November 2012, Sessions Court judge Datuk Jagjit Singh freed them of charges of participating in an illegal assembly on November 10, 2007.

Amelia also allowed the appeal of former Padang Serai MP, N. Gobalakrishnan, for the same offence.

The Sessions Court had found Gobalakrishnan guilty and fined him RM3,000.

All of them were charged with unlawful assembly at several places, including the National Mosque compound, Jalan Istana, Jalan Raja Laut and the vicinity of the Sogo shopping complex on Jalan Tuanku Abdul Rahman.

This case has a chequered history, as all those charge were initially acquitted without their defence being called.

On appeal, the High Court ordered all to enter their defence.

However, with the exception of Gobalakrishnan, Jagjit acquitted them on grounds that the defence had created a doubt in the prosecution case.

The 11 charged are Mohd Zad Abdullah, Mohd Salim Yeslam, Ahmad Razali Abd Rahman, Razali Abdul, Azahar Yusop, Sulaiman Ahmad, Taib Abdullah, Mohd Shafie Ismail, Mohamad Nazreen Mohd Nasir, Mohd Abi Salam Ariffin, and Ishak Othman. – The Malaysian Insider
