KUALA LUMPUR (Dec 1): Kian Joo Can Factory Bhd (KJCF)’s Executive Director Datuk Anthony See has filed an appeal on his suit against Can-One Bhd and few others, that was being struck out by the Kuala Lumpur High Court recently on Nov 14.

In a filing to Bursa Malaysia today, Can-One said its solicitor and that of wholly-owned subsidiary, Can-One International Sdn Bhd, had been served with a Notice of Appeal made by See’s solicitors to the Court of Appeal.

“The Notice of Appeal pertains to the decision of the Kuala Lumpur High Court delivered on Nov 14, 2014, which allowed the applications by both Can-One and Can-One International to strike out the Plaintiff's amended Writ of Summons and amended Statement of Claim,” it said.

See had in May, commenced legal action against Can-One, its unit Can-One International, and four others including KJCF, to prevent Can-One and Can-One International from voting on the sale of KJCF's assets and liabilities to Aspire Insight Sdn Bhd for RM1.47 billion.

The Can-One group controls 32.9% of KJCF and is its biggest shareholder. Aspire Insight meanwhile, is controlled by Chee Khay Leong, Can-One’s former chief operating officer (COO) and current KJCF’s COO, and the Employees Provident Fund.
