(June 2): Punishments under current shariah laws such as for the consumption of alcohol and adultery should match those in Kelantan, PAS Youth said today.

Its chief, Suhaizan Kayat, said this ensured some parts of the party’s Shariah Criminal Offences Enactment or “hudud” would be implemented even as it faced legal roadblocks to getting enforced.

Suhaizan urged his party to push for the amendment of shariah laws to align them with PAS’s penal code.

“Even if we cannot implement it all, we should not just abandon everything,” said Suhaizan in his speech to launch the wing’s assembly in Shah Alam today.

PAS faces legal obstacles in Parliament and the ire of many non-Muslim and Muslim lawmakers towards its intention of wanting to enforce hudud
in Kelantan.

PAS’s enactment would punish adultery, theft, murder, apostasy and consuming alchohol (syurb) and the wrongful accusation of adultery (qazaf) with sentences ranging from whipping, cutting off limbs, stoning and crucifixion.

Individual states along with Sabah and Sarawak each have their own laws to deal with the above offences but the sentences are limited to imprisonment, fines and whipping.

The punishments for four of these offences (adultery, syurb, qazaf, apostasy) are limited to the Shariah Courts Act 1969, said Suhaizan, adding that the act should be amended.

In his speech, Suhaizan also said he was disappointed with Putrajaya for lacking the initiative to push forward the implementation of hudud in Kelantan.

He said the federal government's dilly-dallying on the issue was beginning to appear like it was “playing” with the Islamist party.

Suhaizan said Umno had established a Joint Implementation Committee with PAS on hudud but at the same time appeared to be using the issue to create disharmony within the Pakatan Rakyat (PR) coalition.

He said he was also disappointed that Putrajaya refused to seek the consent of the Council of Malay Rulers to amend the Shariah Courts (Criminal Jurisdiction) Act 1969 (Act 355) which would ensure that the offences such as adultery, qazaf, apostasy and drinking of alcohol were in accordance with the hudud penalties implemented by PAS.

"Unfortunately, the federal government did not bring this matter for consideration, forcing the PAS president to submit the private member's bill in Parliament,"

"The federal government's 'magic show' is actually not too difficult to understand, especially when their strategy is to split the Pakatan using the hudud issue," the speech read.

Suhaizan said he was confident that such tactics would not be able to destabilise PR and distract PAS from its goal of implementing hudud in Kelantan.

"No matter how sly Umno can be, I am sure it will not be able to break PAS collaboration with its partners in PR and its efforts to implement Allah's law." he said. – The Malaysian Insider
