PUTRAJAYA (Jan 4): Former prime minister Datuk Seri Najib Razak, who has been sentenced to 12 years’ jail and fined RM210 million in the SRC International Sdn Bhd case, is seeking to delay the hearing of his appeal against his conviction and sentence in the Court of Appeal.

The hearing is scheduled to begin on Feb 15 but Najib's lead counsel Tan Sri Muhammad Shafee Abdullah said the defence had written to the Court of Appeal for an adjournment.

“This is due to the voluminous notes of proceedings and exhibits which the defence find to be in error and need corrections and verification.

“The defence needs time to observe and make the corrections and hence we have proposed that the Feb 15 hearing date be vacated,” Muhammad Shafee said after attending the case management of the appeal application before the Court of Appeal’s deputy senior registrar N Kanageswari and deputy registrar Darmafikri Abu Adam today.

It is understood that Muhammad Shafee's firm sent a six-page letter to Court of Appeal President Tan Sri Rohana Yusuf today applying for the postponement of the appeal hearing.

The senior lawyer said the Court of Appeal had not made a decision on the request and asked all parties to come back on Jan 25.

Deputy Public Prosecutor (DPP) Mohd Ashrof Adrin Kamarul, meanwhile, said the defence was supposed to hand over three bundles of notes of proceedings to the prosecution.

The first bundle has been agreed upon, while the prosecution received the second one today and is expected to receive the third within two weeks, he said.

“The prosecution will check these bundles of notes of proceedings to ensure they tally with what we have. The first one has been checked and agreed by both of us and given to the court,” he said.

Besides Feb 15, the Court of Appeal also fixed 13 other days later that month and in March to hear the appeal.

High Court Justice Mohd Nazlan Mohd Ghazali found Najib guilty last July 28 of three counts of criminal breach of trust (CBT), three counts of money laundering with regard to RM42 million funds from SRC, and an abuse of power charge involving the approval for the RM4 billion loans given by Retirement Fund (Incorporated) (KWAP) to SRC in 2011 and 2012.
