JUST before May 9, a prominent personality tried to take over a 120-acre tract in Kuala Lumpur that was owned by the government. After much consultation, it was decided that the deal would be deferred until after the general election to avoid controversy.

It was assumed that Barisan Nasional (BN) would retain power and the transaction could then proceed. BN, however, lost to the Pakatan Harapan coalition and the sale has now been aborted.

“It (the tract) is huge and includes a big pond ... they (the prominent individual and developers acting in concert) wanted to build a large development there,” says DAP’s Kepong MP Lim Lip Eng, who has been instrumental in unearthing the sale of choice parcels of land. “It is near my constituency.”

“The [previous] government just could not reject him (the prominent personality) as he was one of the top people in the country,” says Lim, who claims that he got this information from Dewan Bandaraya Kuala Lumpur (DBKL) officers.

He adds that the officers are now saying that aborting the deal was a good thing. “The government gets to keep the land ... this is 120 acres in KL, not somewhere in Sabah or Pahang.”

But that has not stopped a controversy over the sale of land by DBKL during the tenure of former federal territories minister Tengku Adnan Tengku Mansor from coming out.

It is said that there were more than 90 separate transactions in the last four years, which are now the subject of investigations by the Malaysian Anti-Corruption Commission (MACC).

Lim has been on a campaign to expose the sale of 64 parcels amounting to 424 acres for a total of RM4.28 billion.

According to him, some of the parcels were transferred to Yayasan Wilayah Persekutuan — a foundation chaired by Tengku Adnan then — before being sold to certain developers.

The new Federal Territories Minister Khalid Abdul Samad says more than 90 parcels were sold in dubious circumstances by the previous government.

“The actual number ... the total, I am told, is more than 90 plots,” he tells The Edge.

He confirms that the details of the sale of 64 parcels are with MACC and that some of the newly unearthed transactions are still being evaluated by DBKL. The findings will be submitted to MACC if need be.

Why DBKL is even selling land is a puzzle. Khalid says The City Hall’s annual income of close to RM3 billion should be enough for its operations. “So, there is no reason for DBKL to sell land, which is why we are very suspicious of the sales. They (the sales) do not follow the SOPs (standard operating procedures); they do not follow the developments that are being approved; they do not follow the guidelines in terms of density, usage and so on and so forth,” he adds.

Lim claims that the land grabbing in Kuala Lumpur is not limited to DBKL’s land. There are also suggestions that the prices paid for many of the plots were below market value. “Most of them, not all, were [sold] at below market price,” Lim alleges.

There is also talk that in some cases, the bidding process was done via WhatsApp and conducted by a top federal territories ministry official.

One puzzling feature is that the buyer of some of the parcels — suspected to be for Yayasan Wilayah Persekutuan — is listed as Datuk Bandar Kuala Lumpur or Mayor of Kuala Lumpur. The parcels that were acquired were valued at close to RM1.5 billion and include choice locations, such as a 15.24-acre site next to UTC Pudu, which was sold or transferred to Datuk Bandar Kuala Lumpur for RM700 million in October 2015.

A month earlier, in September, Datuk Bandar Kuala Lumpur acquired or transferred 31.7 acres in Kepong for RM418.22 million. In November last year, Datuk Bandar Kuala Lumpur acquired or transferred 54.66 acres for RM279.6 million.

In April last year, a 1.24-acre plot in the Golden Triangle in Jalan Raja Chulan was sold or transferred to Datuk Bandar Kuala Lumpur for RM101.05 million.

When asked about this, Khalid says the acquisitions by Datuk Bandar Kuala Lumpur were odd and that there would be no more land sales under him.

“As far as my ministry is concerned, for the future, we don’t see the need for any land sales and we want to make sure that the land use is in accordance with the local plan. As for the 2030 Local Plan, we will have it reviewed and make it available to the public. We will make sure that DBKL acts professionally in all future cases.”

But how much has been lost? And can action be taken if DBKL did indeed sell land it owned cheaply and fraudulently?

This will only be known when MACC finishes its investigations and the outcome is made public.
