KUALA LUMPUR (Oct 25): Former Melaka chief minister Adly Zahari’s application for leave to initiate a judicial review to challenge the dissolution of the State Legislative Assembly will be heard on Nov 8.

Adly’s lawyer Razlan Hadri Zulkifli confirmed the hearing date when contacted by The Edge on Monday.

The application will be heard in the High Court before Justice Datuk Noorin Badaruddin.

Adly, 50, filed the application last Friday (Oct 22), naming caretaker Chief Minister Datuk Seri Sulaiman Md Ali, Speaker Datuk Seri Ab Rauf Yusoh, the Election Commission and the Yang di-Pertua Negeri Tun Mohd Ali Rustam as respondents.

He is also seeking a declaration that it was illegal for Sulaiman to advise Mohd Ali on Oct 4 to dissolve the legislative assembly as he had by then ceased to command the confidence of the majority of the assemblymen.

Adly is also seeking a declaration that Sulaiman’s advice to dissolve the legislative assembly is manifestly unreasonable and irrational due to the ongoing Covid-19 pandemic.

The new state election is scheduled to be held on Nov 20, with the nomination day slated for Nov 8.
