KUALA LUMPUR (Feb 7): The Taman Tun Dr Ismail Residents' Association (TTDI RA) has urged the Kuala Lumpur mayor and Yayawan Wilayah Persekutuan to not waste public funds on challenging the decision by the Court of Appeal to quash the condominium development in Taman Rimba Kiara, and instead build permanent housing for longhouse residents living in Bukit Kiara.

In a statement, the association said the Court of Appeal's decision was widely hailed as a landmark ruling including by the Malaysian Bar and legal experts.

"The Datuk Bandar [mayor] and Yayasan Wilayah Persekutuan [YWP] should instead demonstrate their willingness to abide by the significant pronouncements issued by the Court of Appeal and concentrate resources on reforms to be in line with the judicial guidance provided," it said.

"As KL residents, we object to even more resources being used by DBKL and/or YWP to appeal a decision which is already so clear and definitive in its handling of the legal issues. DBKL is a government agency and as such, has a role to play to promote and safeguard the interest of the rakyat. And since this is a public interest initiatives championed by the citizens of Kuala Lumpur and supported by the general public, we urge DBKL to perform that role and not to spend valuable resources to challenge the will of the people," it said.

To recap, a three-judge bench at the appelate court led by Federal Court Judge Datuk Mary Lim Thiam Suan had on Jan 27 unanimously decided that the development order obtained in 2017 by the joint venture (JV) of YWP and developer Memang Perkasa for the TRK project is null and void.

The bench, which also included Datuk Has Zanah Mehat and S Nantha Balan, issued an order of ceritiorari to quash the decision of the mayor to grant the development order in relation to a 25-acre site in Taman Rima Kiara.

TTDI RA also echoed an earlier message by Segambut MP Hannah Yeoh to the current Federal Territories Minister Tan Sri Annuar Musa, urging for him to focus on delivering affordable landed homes for 98 longhouse families living on the four-acre longhouse site.

"We request a meeting with the FT Minister, at the soonest practicable time, to collectively engage on the aforesaid townhouse permanent housing plan as proposed previously by the TTDI RA, which in our opinion would be an excellent showcase of the ‘Wilayah Prihatin’ spirit," it said.
