KUALA LUMPUR (Aug 6): The Alor Setar High Court has set aside a judgment in default involving RM142 million in damages against AEON BiG (M) Sdn Bhd.

The judgment is in relation to AEON BiG’s alleged failure to perform an obligation under a lease agreement with Mega Continental Sdn Bhd in Alor Setar, Kedah.

“Therefore, Mega Continental no longer has any judgment against AEON BiG and AEON BiG has instructed its solicitors to proceed to file an application to strike out the suit filed by Mega Continental,” AEON BiG said in a statement today.

“AEON BiG has been advised by its solicitor that since AEON BiG had filed the application to stay the execution of and set aside the judgment in default granted to Mega Continental on June 9, it might not have been proper for Mega Continental to carry out the seizure of AEON Big Subang hypermarket one day before the hearing,” it added.

On July 14, theedgemarkets.com reported that the Japanese retailer’s headquarters in Subang Jaya, where the store is also located, had been sealed over the company’s failure to settle the judgment sum of RM142 million. A day later, AEON BiG said the High Court in Alor Setar had allowed the company’s application for a stay of execution of the judgment in default, and the outlet recommenced operations.

According to AEON BiG's statement today, legal actions will be taken against Mega Continental for “the loss of income, loss of reputation and the unnecessary inconvenience caused to our customers, our people and our partners”. 

“We are very grateful that despite this tough time, our customers, suppliers, banks and partners continue to stand strong with us. With the trust and support, we manage to turnaround the company and will continue to be resilient to execute our transformation plan laid for AEON BiG,” said the company’s managing director Shafie Shamsuddin.
