KUALA LUMPUR (March 29): Amaniaga Resources Sdn Bhd has clarified that EA Technique Bhd, which has filed a suit against the company, owes it close to RM9 million under the Construction Industry Payment and Adjudication Act Adjudication Award.

The oil and gas solutions provider said EA Technique had failed to pay the sum, which the adjudication award dated March 5 had ruled was due by March 12.

Amaniaga had therefore applied to the High Court to enforce the award on March 14, the company said via a clarification letter from its solicitors.

Yesterday, EA Technique said in a filing with Bursa Malaysia that it had filed a US$7.06 million (RM27.38 million) suit against Amaniaga for an alleged breach of contract to provide services for a floating storage and offloading (FSO) vessel.

The listed entity claimed that Amaniaga had breached a January 2016 contract for the provision of transportation and offshore installation service of a FSO vessel with its mooring and riser system for the full field development project North Malay Basin.

EA Technique said it subsequently filed a suit against Amaniaga on March 20.

Amaniaga claims that the subject matter in EA Technique's suit was canvassed during the adjudication process and rejected by the adjudicator in his March 5 award.

On top of that, the matter is subject to an arbitration agreement, Amaniaga said.

"(We have) therefore today moved to stay the proceedings of EA Technique's writ of summons for its failure to resort to arbitration," the company said.
