KUALA LUMPUR (Aug 29): Representatives of the Taman Tun Dr Ismail Residents Association (TTDI RA) have obtained leave from court to pursue a judicial review against Dewan Bandaraya Kuala Lumpur (DBKL) and mayor Datuk Bandar KL with regards to the controversial proposed development at Rimba Kiara Park located in Taman Tun Dr Ismail (TTDI).

The parties to the judicial review application are the management bodies of the five apartment complexes most proximate to the park, TTDI RA and various individual residents of TTDI in their individual capacity.

According to TTDI RA, leave was granted by the High Court on Aug 23 and the judicial review papers have been served on respondents DBKL and Datuk Bandar KL as of Aug 28. The High Court has fixed Sept 6 for case management. The respondents are expected to be present.

The judicial review application requests amongst others for an order by the court to quash and stay the conditional planning permission and a development order granted by DBKL to developer Memang Perkasa Sdn Bhd on Feb 28 and July 13 respectively.

Additionally, the judicial review requests Datuk Bandar KL to adopt and gazette the KL Draft City 2020, which recognises Rimba Kiara Park as a public park.

These were disclosed today at a press conference by TTDI RA.

Memang Perkasa is controlled by Malton Bhd, which has a 51% stake in it. When asked if the developer was made aware of the situation, TTDI RA said it intended to write to the developer.

The controversial development of the park came to light last year when residents of the neighbourhood discovered development plans by the city hall.

A development notice by DBKL states that the proposed development will comprise a 29-storey block of 350 affordable apartments and another eight blocks of up to 54 storeys with nearly 1,800 high-end serviced apartments.

The affordable apartments are the proposed solution to house the 100-odd families, formerly estate workers, who are currently residing in long houses next to the park.

"We wish that the issue of preserving Taman Rimba Kiara did not have to enter an adversarial situation. However, the actions of the authorities in relation to the matter have left the community and park lovers no choice but to seek redress," said Leon Koay, a committee member of the Save Taman Rima Kiara campaign group.
