KUALA LUMPUR (Oct 25): Former prime minister Datuk Seri Najib Razak and former treasury secretary-general Tan Sri Mohd Irwan Serigar have arrived at the Kuala Lumpur Court Complex this morning to face criminal breach of trust (CBT) charges.

The duo was summoned to the MACC headquarters yesterday to complete the final investigation and prosecution process. Najib was free to go after three hours, while Mohd Irwan was arrested shortly after arrival. 

Mohd Irwan, dressed in a black suit and tie, was not his usual cheerful self when he arrived at 8.13am in a black MPV amid police escort.

Najib arrived shortly after 8.23am in a black sedan, still able to smile and greet the press as he walked into the complex.

Najib and Mohd Irwan will jointly face the charges under Section 409 of the Penal Code, according to an spokesperson for the Malaysian Anti-Corruption Commission (MACC).

The charges, said MACC, is in relation to misappropriation of government funds. It is learnt that it included funds slated for BR1M, as well as monies parked in the government's Consolidated Fund.

The charges will be read at the Sessions Court (criminal) in front of Sessions Court judge Azman Ahmad at 9am.

News agencies reported that the sum could be as high as RM6 billion, and that it was used to pay 1MDB debts, including to finance the US$1.2 billion owed to Abu Dhabi sovereign wealth fund IPIC in a settlement agreement between the two in 2017.

Najib, who was also former finance minister, once served as the chairman of 1MDB's board of advisors. Mohd Irwan also served as 1MDB chairman between May 2017 and May 2018.

Separately, former Malaysian External Intelligence Organisation (MEIO) director general Datuk Hasanah Ab Hamid is also expected to face CBT charges today.

She was previously investigated by the MACC alongside seven other MEIO officers in August, on alleged misappropriation of US$12 million government funds during the 14th General Election.

At press time, it is understood that Hasanah had arrived, having avoided the media by using a separate entry.

Hasanah's charges, also under allegations of misappropriation of government funds, will be read in front of Sessions Court judge Rozina Ayob at 9am.

This would be the fourth time Najib has been brought to court on graft-related offences since July, while Mohd Irwan and Hasanah are facing charges for the first time.
