KUALA LUMPUR (Sept 26): The criminal case against former Menang Corp Bhd's managing director and chief executive officer (CEO) Datuk Eddie Shun Leong Kwong has been fixed for a third mention on Nov 3 by the Sessions Court today.

Judge Hasbullah Adam granted Deputy Public Prosecutor Faridah Nurdini's request for more time to serve court documents to Shun's lawyers.

Shun, who was charged under Section 420 of the Penal Code for allegedly cheating and dishonestly inducing delivery of property, pleaded not guilty on Aug 2. 

On that day, he posted bail at RM20,000 with one surety. Shun was represented by lawyers Cheow Wee and Zander Lim.

Previous reports state that Shun, 78, was allegedly charged with questionable land dealings involving two companies, The Continuum Sanctuary Commercial Sdn Bhd and Menang's wholly-owned Menang Development (M) Sdn Bhd (MDSD).

Shun is alleged to have sold some pieces of land belonging to Menang and acquired some for himself, and these transactions had not been disclosed in the company's books.

Shun resigned as Menang's MD and CEO this year, after holding the posts since 1989. He now holds a non-executive position on the board.

On Aug 15, property developer and construction company Menang told Bursa Malaysia it was unaware of investigations against MDSD.

Menang also said it was 'clear and obvious' that Shun had authority to enter into land transactions for and on behalf of the company in the ordinary course of business.

However, the company did not have any recorded transactions of sale of properties to Shun.

According to the law, Shun can be sentenced up to 10 years in jail with whipping, and fined, if found guilty.

At 11.27am, Menang shares remained unchanged at 91 sen with 120,300 shares exchanging hands, for a market capitalisation of RM244.4 million.
