PETALING JAYA (Dec 28): Country Garden Danga Bay Sdn Bhd (CGDB) — the developer of the Danga Bay mega-project in Johor — will appeal against the decision made by Johor Baru High Court today on a judicial review of the state’s housing tribunal’s award.

CGDB, in its statement today, said the Johor Baru high court has dismissed CGDB’s application for a judicial review to quash the Housing and Strata Management Tribunal award granted in favour of one of the purchasers, Ho Chee Kian, on June 7, 2018.

“Respectfully, CGDB does not agree with the said decision and upon consultation with our lawyers, we will proceed to appeal against this decision at the Court of Appeal.

“CGDB has always been a law-abiding corporate citizen, having the utmost respect of the laws in force in Malaysia,” said the company in a press statement today.

To recap, the Johor Baru Housing tribunal president had awarded RM50,000 compensation to Ho, based on claims submitted by him earlier for his purchase of a unit in the Danga Bay Project.

However, CGDB applied for a stay of execution of the award and applied for a judicial review through its lawyers Messrs Tay & Partners.

In early March, a group of buyers of the luxury high-rise development had lodged a report with the Housing and Strata Management Tribunal, alleging low-quality workmanship and that materials used were not in accordance with the details stated in the sale and purchase agreement.

According to ealier news reports, the developer has agreed to a defect liability period of 27 months for the buyers to submit their defects report and let the developer rectify them — an additional three months on top of the usual 24 months.

“CGDB values and welcomes feedback with open arms from our purchasers to seek clarification should there be doubts. We will continue to engage with our buyers and open a line of communication during this period to ensure their rights, interest, and welfare is taken care of,” stressed CGDB.
