(May 8): Two Perodua Myvi drivers pleaded not guilty in the Kuala Lumpur magistrate’s court today to charges of reckless driving and causing death, related to a fatal accident at the Duta-Ulu Klang Expressway (DUKE) last Saturday.

Mohammed Reza Fizal Jamaluddin, 31, and Siti Noor Aini Mohd Said, 35, were charged under Section 41 of the Road Transport Act 1987.

It was reported that in the 1.05am incident, Fairuz Nizam Husain, 35, his wife Nova Safitri Azhari, 25, and their seven-month-old baby girl Nur Firuza Annisa, were killed in the crash involving three vehicles at Km6.2 of the DUKE highway.

Following the incident, police arrested a 31-year-old man and a 35-year-old woman to facilitate investigations.

Deputy public prosecutor Suhaimi Ibrahim today asked the court to impose bail of RM15,000 in one surety, hold both the accused passports and suspend their driving licences until the completion of the trial.

However, lawyers representing Noor Aini asked for bail was reduced to RM5,000 on the grounds that his client was working as an assistant manager of a restaurant with an income of RM2,000 a month.

"The accused also has to take care of a child of eight and a mother.

"The bail is simply a guarantee to ensure the accused appears in court," he said.

The lawyer representing Reza also asked the court to reduce bail, saying his client had to care for his two small children.

He said Reza works as a technician, earning RM2,000 a month and his wife worked as a clerk, added that the RM15,000 bail was too high.

After hearing the submissions, judge Noorul Fhaiez Mohd Nayan set the bail for both at RM9,000 each.

The judge also ordered them to hand over their passports and suspended driving licences.  

The court fixed June 22 for mention. – The Malaysian Insider
